CLASS ACTION TYPE REPRESENTATIONS

CONSUMER CLASS ACTIONS

Spa Universaire and Vacation Tan & Travel v. Qwest Commun’s Int’l, Inc., and Qwest Corp., Civ. Action Nos. 02—978 & 1977 (BNB) (D. Colo.).  Serving as local counsel for plaintiffs in proposed class action against regional telephone service provider for violation of federal antitrust and telecommunications law and state common law. 

Miller v. Image Data, LLC, 2004 WL 326998 (10th Cir. Feb. 23, 2004).  Served as lead counsel in successfully defending proposed class action on behalf of millions of Coloradoans purporting to sue under the federal Driver’s Privacy Protection Act, 18 U.S.C. § 2721 et seq., and C.R.S. § 42-1-206.

Colour Editions, Inc., d/b/a King Kolor v. Encad, Inc., Civ. Action No. 98-D-2490 (D. Colo.).  Served as antitrust and local counsel for national plaintiffs’ class in antitrust action for tying purchase of wide-format commercial ink-jet printers and cartridges, resulting in class recovery valued in millions of dollars.

Abrams v. Southeastern Municipal Bonds, Inc., [1991 Transfer Binder] Fed. Sec. L. Rep. (CCH) 96,055 (D. Colo. 1991), [1990-91 Transfer Binder] Fed. Sec. L. Rep. (CCH) 95,757 (D. Colo. 1990).  Served as co-lead class counsel in securities fraud national class action stemming from defaulted Colorado special district bond issue, resulting in recovery of $7.3 million on behalf of bondholders nationwide.

In re Ins. Antitrust Litig., 723 F. Supp. 464 (N.D. Calif. 1989), rev’d, 938 F.2d 919 (9th Cir. 1991), aff’d in part, rev’d in part sub nom. Hartford Fire Ins. Co. v. California, 113 S. Ct. 2891 (1993).  Served as lead counsel for State of Colorado in antitrust national class action by states against insurers for boycotting governmental entities relative to provision of commercial general liability insurance coverage, ultimately resulting in multi-million dollar recovery.

In re Cement Indus. Antitrust Litig., CV No. 76-929 PHX CAM (MDL).  Served as lead counsel for state and local governmental entities in Colorado (1981-84) in antitrust national class action for price fixing of cement sold to governmental entities, resulting in six-figure recovery.

PARENS PATRIAE CASES

Colorado v. Rick’s Hauling Serv., Inc., Civ. Act. No. 84-K-312 (D. Colo. 1984).  Served as lead counsel for Colorado Attorney General in federal antitrust parens patriae action (i.e., statutory consumer class action by state attorney general on behalf of natural persons residing in state, under Clayton Act Sec. 4C, 15 U.S.C. §15c) against trash haulers and their association for price fixing and market allocation relating to trash hauling services, resulting in injunction and six-figure recovery on behalf of Colorado residents.

Colorado v. Aspen Hotel Mgt., Inc., Civ. Act. No. 81-F-841 (D. Colo. 1981).  Served as lead counsel for Colorado Attorney General in federal antitrust parens patriae action against hotels and resort association for price fixing of lodging accommodations, resulting in recovery injunction and six-figure recovery on behalf of Colorado residents.
